Aje Wholesaling Pty Ltd (ABN 26 130 160 753) (Aje or our or we) is an Australian fashion house which sells designer clothing, accessories, jewellery and associated services (Services).

This Policy governs how Aje deals with your personal information collected in connection with the Services.

This Policy also applies to Personal Information collected by Aje in connection with its website, social media accounts, store point-of-sale, applications, software and other technological means (Online Platforms), as well as in connection with any direct communication between you and Aje.

By continuing to use the Online Platforms and the Services, you consent to Aje using your Personal Information in accordance with this policy.

Aje uses third parties located both locally and overseas in addition to its own resources to provide these Services.

Scope of this Policy

Aje understands that when accessing our Services, the privacy and confidentiality of Personal Information (as defined under the Privacy Act) is important to you. Aje fully respects your rights to privacy and are committed to protecting the personal and financial details you provide us in line with this Privacy Policy. This Privacy Policy applies to our Services and all individuals who use our Services or whose Personal Information is processed by Aje.

    • Aje collects your Personal Information so that we can carry out the following actions:
      to enable you to use our Online Platforms;
      to provide our Services;
      to communicate with you, including about our Services and offers which might interest you;

      Aje partners with Rakuten Advertising, who may collect personal information when you interact with our digital property, including IP addresses, digital identifiers, information about your web browsing and app usage and how you interact with our properties and ads for a variety of purposes, such as personalization of offers or advertisements, analytics about how you engage with websites or ads and other commercial purposes.   1. HOW INFORMATION IS COLLECTED

Information is collected in association with your use of the Services, an enquiry about Aje or generally dealing with us directly or via our Online Platforms.

  1. WHEN PERSONAL INFORMATION IS USED & DISCLOSED

    • We will not use any Personal Information other than for the purpose for which it was collected other than with the individual’s permission.
      We will retain Personal Information for the period necessary to fulfill the purposes outlined in this Privacy Policy unless a longer retention period is required or permitted by law.
      Subject to clause 13, we will not sell an individual’s Personal Information to unrelated third parties.
      There are some circumstances in which we must disclose an individual’s information:
      where we reasonably believe that an individual may be engaged in fraudulent, deceptive or unlawful activity that a governmental authority should be made aware of;
      as required by any law (including the Privacy Act and GDPR); and/or
      in order to sell our business (in that we may need to transfer Personal Information to a new owner).

Sensitive information is information about you that reveals your racial or ethnic origin, political opinions, religious or philosophical beliefs or affiliations, membership of a professional or trade association, membership of a trade union, details of health, disability, sexual orientation or criminal record.

It is our policy to only collect your sensitive information where it is reasonably necessary for our functions or activities and either you have consented or we are required or authorised under law to do so.

  1. OPTING “IN” OR “OUT”
    • By clicking “I Agree” or any other button indicating your acceptance of this privacy policy, you expressly consent to the collection and use of your Personal Information in accordance with this privacy policy.
    • An individual may opt to not have us collect their Personal Information. This may prevent us from offering them some or all of our services and may terminate their access to some or all of the services they access with or through us. They will be aware of this when the Privacy Principles apply to us:

Aje use temporary (session) cookies and/or permanent cookies when you access our Online Platforms and/or Services. This allows us to recognise your browser and track the web pages you have visited. To opt out of personalised internet advertisement of the Aje website and products, you may at any time disable cookies via the settings within your browser, or an opt-out tool.

You can also request deletion of your data with Aje by emailing us at customerservice@ajeworld.com, and/or completing this form with our third party advertising agency, Rakuten.

  1. THE SAFETY AND SECURITY OF PERSONAL INFORMATION
    • We may hold your Personal Information in either electronic or hard copy form.
    • If you provide information to us electronically we retain this information in our computer systems and databases. If you provide information to us in hard copy (paper) this information is normally retained in our files and a copy is made to our electronic files.
    • We use industry standard security measures to safeguard and protect your information.
    • We may disclose your Personal Information to third parties and service providers located overseas in connection with any purpose, including to overseas cloud computing hosts. We take reasonable steps to ensure that the overseas recipients of your Personal Information do not breach the privacy obligations relating to your Personal Information.
    • We are not responsible for the privacy or security practices of any third party (including third parties that we are permitted to disclose an individual’s Personal Information to in accordance with this policy or any applicable laws). The collection and use of an individual’s information by such third parties may be subject to separate privacy and security policies.
    • If an individual suspects any misuse or loss of, or unauthorised access to, their Personal Information, they should let us know immediately.
    • We are not liable for any loss, damage or claim arising out of another person’s use of the Personal Information where we were authorised to provide that person with the Personal Information

        • If you would like us to provide copies to you of your Personal Information which we hold, please contact us at customerservice@ajeworld.com and we will comply with your request to the extent required by law.

  3. RIGHT TO BE FORGOTTEN

In the event that you decide that you no longer want Aje to hold your Personal Information, you may notify us in writing of your desire for us to delete your Personal Information on record. We will use our best endeavours and comply with all legal requirements within a reasonable timeframe to delete your Personal Information, unless we are required by law to retain such information.

Links from our Online Platforms or via our Services to third party services that we do not operate or control are provided for your convenience. We are not responsible for the privacy or security practices of services that are not covered by this Privacy Policy. Third party services should have their own privacy and security policies which we encourage you to read before supplying any Personal Information to them.

  1. DIRECT MARKETING

Aje and our carefully selected third party business providers may contact you with direct marketing communications and information about the Services or other products and services offered by us via telephone, email, SMS, or regular mail.

If you have indicated a preference for a method of communication, we will endeavour to use that method wherever practical to do so.

You may opt out of receiving marketing communications at any time by responding via the channel in which you received the marketing communication, or by contacting us (see contact information below). You can unsubscribe from emails by clicking the unsubscribe link on the footer of the email communication you have received.

  • If we become aware of any unauthorised access to an individual’s Personal Information we will inform them at the earliest practical opportunity once we have established what was accessed and how it was accessed.

    accessing our Online Platforms or receiving our Services from within the European Union,
    then in addition to our obligations under the Privacy Act, Aje is required to comply with the GDPR with respect to your Personal Information.
    Any reference to Personal Information in this Privacy Policy is also a reference to Personal Data (as defined under the GDPR).
    Aje takes the security and privacy of your Personal Information seriously and has prepared this privacy policy and taken measures to collect, process and hold all Personal Information in compliance with both the Privacy Act and GDPR regardless of the user. Therefore, no additional terms for GDPR users are required.

    The categories of Personal Information we have collected about consumers and disclosed about consumers for a business purpose in the preceding 12 months include:

    • Identifiers such as a real name, alias, postal address, email address, unique personal or online identifier, Internet Protocol address, account name;
    • Personal information including telephone number, credit card number, debit card number; education and employment or employment history (for recruiting and employment purposes);
    • Commercial information, including products or services purchased, obtained, or considered; other purchasing or consuming histories or tendencies;
    • Internet or other electronic network activity information, including browsing history, search history, and information regarding a consumer’s interaction with an internet website, or advertisement;
    • Geolocation data;
    • Professional or employment-related information; and
    • Inferences drawn from any of the information identified to create a profile about a consumer reflecting the consumer’s preferences, intelligence, abilities, and aptitudes.

    We do not sell Personal Information and have not sold Personal Information about consumers in the preceding 12 months.

    Personal Information subject rights under the CCPA may apply to certain individuals and households. These rights include the right to: (i) know what Personal Information is being collected about them, (ii) know whether their Personal Information is sold or disclosed and to whom, (iii) say no to the sale of Personal information, (iv) access their Personal Information, and (v) equal service and price, even if privacy rights are exercised.

    CHILDREN'S PRIVACY

    Users must be 18 years of age or older to purchase products through the Site. The Services are not directed to children under 16 years of age, and Aje does not knowingly collect Personal Information from children under 16 years of age. If you learn that your child has provided us with Personal Information without your consent, you may alert us at customerservice@ajeworld.com. If we learn that we have collected any Personal Information from children under 16 years old, we will promptly take steps to delete such information and terminate the child's account.

Prize Conditions
No part of this prize is exchangeable, redeemable for cash or any other prize or transferable.

Subject to the terms and conditions of the participating prize provider(s), if for any reason the
winner does not, once the prize has been booked, take the prize (or an element of the prize) at
the time stipulated, then the prize (or that element of the prize) will be forfeited and will not be

Use of Entrant Information
By entering the promotion, you acknowledge and agree that the promoters (Aje Wholesaling Pty

Conditions of Entry
1. The entrant agrees and acknowledges that they have read these conditions of entry and
that entry into the promotion is deemed to be acceptance of these conditions of entry.
2. The promotion commences on the start date and ends on the end date ("promotional
period"). Entries are deemed to be received at the time of receipt by the promoters and
not at the time of transmission or deposit by the entrant. Records of the promoters and
their agencies are final and conclusive as to the time of receipt.
3. Valid and eligible entries will be accepted during the promotional period.
4. Employees (and the immediate family members) of agencies/companies directly
associated with the conduct of this promotion, the promoters, its distributors, suppliers,
subsidiary companies/businesses and associated companies and agencies are not
eligible to enter. "Immediate family member" means any of the following: spouse,
ex-spouse, de-facto spouse, child or step-child (whether natural or by adoption), parent,
step-parent, grandparent, step-grandparent, uncle, aunt, niece, nephew, brother, sister,

5. Draw
a) The draw will take place at Aje Wholesaling Pty Ltd, 532 Riley St, Surry Hills NSW
2010, Australia on 17/11/23 at 09:00am AEDT.
b) The first valid entry drawn will be the winner of the draw prize specified in the
schedule above.
c) If a draw is scheduled on the weekend or a public holiday, the draw will be conducted
at the same time and location on the following business day. The promoters will
ensure each draw is open for public scrutiny and anyone may witness the draw on
request. The winner of a drawn prize is determined by chance.
6. All reasonable attempts will be made to contact each winner.
7. If any winner chooses not to take their prize (or is unable to), or does not take or claim a
prize by the time specified by the promoters, they forfeit the prize and the promoters are
not obliged to substitute the prize.
8. Entry and continued participation in the promotion is dependent on the entrant following
and acting in accordance with the conditions of entry.
9. The value of the prizes is accurate and based upon the recommended retail value of the
prizes at the date of printing. The promoters accept no responsibility for any variation in
the value of the prizes after that date.
10. If a prize (or portion of a prize) is unavailable the promoters reserve the right to
substitute the prize (or that portion of the prize) to a prize of equal or greater value
and/or specification, subject to any written directions of a regulatory authority.
11. No entry fee is charged by the promoters to enter the promotion. Where entry is allowed
online, there is no additional cost to enter the promotion other than any cost paid by the
entrant to access the website or social media platform of entry via their Internet service
provider.
12. If there is a dispute as to the identity of an entrant or winner, the promoters reserve the
right, in its sole discretion, to determine the identity of the entrant or winner.
13. Entrants' personal information will be collected by the promoters. Personal information
will be stored on the promoter's database. The promoters may use this information for
future marketing purposes regarding its products, including contacting the entrant
electronically. The promoters are bound by the Australian Privacy Principles in
accordance with the Privacy Act 1988 (Cth) and its privacy policy. The Promoter's
privacy policy contains information about how the entrant may access, update and seek
correction of the personal information the promoters hold about them and how the
entrant may complain about any potential breach by the promoters of the Australian
Privacy Principles or any other Australian privacy laws and how such complaints will be
dealt with. The promoters collect personal information about entrants to enable them to
participate in this promotion and may disclose the entrants' personal information to third
parties including its contractors and agents, prize suppliers and service providers to
assist in conducting this Promotion and to the State and Territory lottery departments as
required under the relevant lottery legislation. If the entrant does not provide their
personal information as requested, they may be ineligible to enter or claim a prize in the
promotion. Personal information collected from entrants will not be disclosed to any
entity located outside of Australia.
14. If this promotion is hosted, administered, advertised or operated on a third party
platform, then by participating in this promotion, entrants hereby release and agree to
comply with all rules and policies set forth by such Third Party Platform and to hold
harmless such third party platform from any and all liability, loss or damages arising from
or in connection with the awarding, receipt, and/or use or misuse of prizes or
participation in any prize related activities. Unless otherwise stated to the contrary in
these Official Rules, this Sweepstakes is not sponsored, endorsed or administered by, or
associated with, any third party platform.
15. It is a condition of accepting the prize that a winner and their travel companion may be
required to sign a legal release as determined by the promoters in its absolute discretion,
prior to receiving a prize.
17. Any guarantee or warranty given is in addition to any relevant statutory guarantees and
warranties and nothing in these conditions of entry restricts, excludes or modifies or
purports to restrict, exclude or modify any statutory consumer rights under any
applicable law including the Competition and Consumer Act 2010 (Cth).
18. If for any reason any aspect of this promotion is not capable of running as planned,
including by reason of computer virus, communications network failure, bugs, tampering,
unauthorised intervention, fraud, technical failure or any cause beyond the control of the
promoters, the promoters may in its sole discretion cancel, terminate, modify suspend
the promotion and invalidate any affected entries, or suspend or modify a prize, subject
to State or Territory regulation.
19. The promoters reserve the right, at any time, to validate and check the authenticity of
entries and entrant's details (including an entrant's identity, age and place of residence).
In the event that a winner cannot provide suitable proof as required by the Promoters to
validate their entry, the winner will forfeit the prize in whole and no substitute will be
offered. Incomplete, indecipherable, inaudible, incorrect and illegible entries, as
applicable, will at the promoter's discretion be deemed invalid and not eligible to win.
Entries containing offensive or defamatory comments, or which breach any law or
infringe any third party rights, including intellectual property rights, are not eligible to win.
The use of any automated entry software or any other mechanical or electronic means
that allows an individual to automatically enter repeatedly is prohibited and may render
all entries submitted by that individual invalid.
20. The promoters reserve the right to disqualify entries in the event of non-compliance with
these conditions of entry. In the event that there is a dispute concerning the conduct of
the promotion, the decision of the Promoters are final and binding on each entrant and
no correspondence will be entered into.
21. The promoters and their associated agencies and companies will not be liable for any
loss (including, without limitation, indirect, special or consequential loss or loss of
profits), expense, damage, personal injury or death which is suffered or sustained
(whether or not arising from any person's negligence or wilful misconduct) in connection
with this promotion or accepting or using any prize (or recommendation), except for any
liability which cannot be excluded by law (in which case that liability is limited to the
minimum allowable by law).
22. Unless otherwise specified, a prize is a single event for the winner (and their guest) and
cannot be separated into separate events or components.
23. The promoters accept no responsibility for any tax implications and the entrant must
seek their own independent financial advice in regards to the tax implications relating to
